Supreme Court Upholds Bail Denial for Mike Chimombe

On 6th March 2025, the Supreme Court dismissed Mike Chimombe’s bail appeal, affirming the High Court’s earlier decision to deny him bail. The court ruled that the state had presented compelling reasons for his continued detention, including the risk of absconding, the gravity of the charges, and the potential for witness interference.

Chimombe is at the centre of a high-profile fraud case involving allegations of misappropriating funds linked to the Presidential goat-pass-on scheme. He was arrested in 2024 alongside his co-accused. In July 2024, the magistrate’s court initially denied him bail, citing concerns that he might flee or interfere with witnesses.

Following this, Chimombe appealed to the High Court, but the appeal was overtaken by events when he and his co-accused were indicted for trial. In January 2025, Chimombe submitted another bail application to the High Court, which was also rejected. The court reiterated the magistrate’s findings, stressing the seriousness of the charges and the risk of witness interference.

Chimombe then escalated his case to the Supreme Court, arguing that the High Court had erred by relying on the magistrate’s earlier findings instead of independently assessing his bail application. He claimed that the state had failed to provide sufficient justification for his continued detention. However, the Supreme Court upheld the High Court’s decision, maintaining that the reasons for denying bail were valid.
